MOBILE TICKETING TERMS & CONDITIONS

Thank you for using the Roaring Fork Transportation Authority’s (RFTA) Mobile Ticketing Application. Your use is expressly subject to and conditioned upon these terms and conditions.  By clicking on the link below, you agree to accept these terms and conditions and the general terms of use relating to the website managed by RFTA. Visit the general terms of use on the RFTA website to learn more. RFTA’s Mobile Tickets Application is brought to you by RFTA, with mobile ticket sales provided by Masabi LLC (Masabi). RFTA and Masabi may modify these terms and conditions at any time by posting revised terms and conditions.

MOBILE TICKETING

Mobile tickets application “Mobile Tickets App” refers to RFTA’s mobile ticketing application on an iOS or Android device. “Third-party Application” refers to RFTA-authorized third-party mobility applications on an iOS or Android device. Mobile Ticket or “mTicket” refers to a type of ticket or pass purchased through the RFTA Tickets App or Third-party Application. Tickets and Monthly Passes are valid for use on RFTA bus services except for Access-a-Ride Services and RFTA Special Services, when available. Access-a-Ride tickets are only valid on Access-a-Ride Service. “Stored Value” refers to funds loaded onto the RFTA Tickets application. The “Stored Value Account” is part of the customer account in RFTA’s Tickets App. Customers can use these pre-loaded Stored Value Account funds as a payment method when purchasing mTickets. Stored Value funds are not valid for travel on RFTA services; the customer must purchase and activate an mTicket to pay the fare. The security of your mobile phone or mTicket is your responsibility.

RFTA recommends that you create an RFTA Tickets App account for your protection. If your mobile phone is lost or stolen, you will be able to migrate unused, unexpired mTickets as well as any unused balance on a Stored Value Account to your new mobile device when logging into your customer account on the new device. If you delete the RFTA Mobile Tickets App, you will also delete your mTickets from your device. If you reinstall the RFTA Mobile Tickets App on the mobile device it was deleted from and log into your account, your tickets will be downloaded to the device. RFTA will not provide a duplicate or replacement mTicket for used or expired mTickets.

Your mTicket must be activated before boarding an RFTA revenue vehicle and must be displayed clearly on a mobile phone screen to the operator every time you board a RFTA revenue vehicle or when requested by a fare inspector, road supervisor, or police officer. Retain the mTicket during your entire trip on RFTA revenue vehicles. Failure to show an active, valid ticket is considered fare evasion and is subject to enforcement actions according to RFTA policy and local and state laws. You cannot print mTickets or transfer tickets to other individuals.

However, you may purchase and activate multiple tickets on the same mobile device for a group riding together. You will have to display an active, valid mTicket for each member of your group to the operator every time you board a RFTA revenue vehicle or when requested by a fare inspector or police officer.

Your RFTA mTicket or Stored Value is sold to you via RFTA’s mobile ticketing partner, Masabi. The mTicket itself creates a contract between you and RFTA to provide the transport services that the mTicket allows you to use. It is RFTA that provides these transport services to you. In no event will Masabi, or any third-party mobile app ticket seller, be responsible for, or have any liability to you, concerning these transport services or their availability or performance (including your use or access to any RFTA revenue vehicle, the RFTA network, your use of any services provided under your mTicket, or for your use of the RFTA Tickets App).

RFTA TICKETS MOBILE APPLICATION

RFTA grants you the right to download, install and use the RFTA Tickets App on your mobile device to purchase mTickets and Stored Value and access information in accordance with these terms and conditions. You do not and will not own the RFTA Tickets App or any information that is provided to you through it or RFTA, but you may use the application in accordance with these terms and conditions solely for the purposes of purchasing mTickets and Stored value, using mTickets, and accessing transport information for your personal use and not for any other purpose. The RFTA Tickets application is provided to you free of charge. However, RFTA can suspend access to purchasing mTickets and Stored Value through the RFTA Mobile Tickets App and can do so for any reason.

THIRD-PARTY APPLICATION CHANNEL SALES

Currently, the only RFTA-authorized Third-party Applications that fulfill RFTA mTickets is the Transit app. The RFTA Tickets App and the Third-party Applications are wholly different and separate applications, governed by separate Privacy Policies and Terms and Conditions of Use, which you can review on the respective applications. Login credentials and accounts between the RFTA Tickets App and the Third-party Applications are not shared. Your RFTA Tickets App account is different from your Third-party Application account. Your RFTA Mobile Tickets App ticket wallet only stores RFTA mTickets purchased from the RFTA Tickets App. Your ticket wallet in a Third-party Application only stores RFTA mTickets purchased from the Third-party Application. RFTA mTickets purchased in the Third-party Application will only be available in the Third-party Application. RFTA mTickets purchased in the RFTA Tickets App will only be available in the RFTA Tickets App and are not transferable to a Third-party Application. RFTA Stored Value Accounts are only available in the RFTA Tickets App and are only available for purchasing mTickets in the RFTA Tickets App. Funds are not transferable to a Third-party Application. RFTA mTickets can only be applied towards RFTA transit services and cannot be applied towards mobility services offered by Third-party Applications. Other mobility services, such as ride-hailing, scooters, and bike-sharing services, are not available in the RFTA Mobile Tickets App. RFTA mTickets purchased in a Third-party Application will be sold to you by RFTA through its mobile ticketing partner, Masabi, in the Third-party Application.

PRICES AND RECEIPTS

Tickets App will notify you of the price before confirming your purchase. For information on fares, please visit the RFTA fare information web page at https://www.rfta.com/fares/. Once you complete your purchase, a receipt will be emailed to the email address you provided.

DISCOUNT FARES (NOT APPLICABLE FOR ACCESS-A-RIDE SERVICES)

Discount fares apply to individuals with disabilities and veterans or active military. Youth discount fares apply to youth ages 6-18 (children 5 and younger in groups of 9 or fewer ride free). Proof of eligibility is required for all passengers using discounted fare products. The unauthorized use of discounted fare products is a form of fare evasion and will be enforced according to RFTA policy and local and state laws. DATA CHARGES AND CONNECTIVITY

The RFTA Tickets App is free, but you may incur data charges from your cell phone network provider. You are responsible for any such costs. RFTA will not take responsibility for any connectivity issues you may experience.

AVAILABILITY & UPDATES

Travel is based on fare applicability on RFTA services at the time of purchasing a ticket.

Once purchased, the mTicket will specify the fare type and the ticket’s validity.

RFTA reserves the right to issue updates to the RFTA Tickets App, in which case you may not be able to continue using the version of the RFTA Tickets App installed on your mobile device without downloading the latest update. Therefore, RFTA recommends that you download and install all updates issued. RFTA is not liable for errors that become apparent in old versions of the RFTA Tickets App.

CHANGES, REFUNDS, AND REPLACEMENTS

All sales are final. mTickets will only be replaced under special circumstances, including but not limited to service disruptions of the RFTA Tickets App. RFTA will not issue duplicate or replacement tickets for mTickets used without your permission and will not replenish funds in a Stored Value Account used without your consent by a person to whom you have given access to your mobile device or customer account. If the mTicket is damaged or is not readable in any way, it becomes invalid; you must purchase a new ticket.

The decision to change, cancel, refund, or replace an mTicket is at RFTA’s sole and absolute discretion. Neither RFTA nor Masabi shall be obliged to change, cancel, or replace an mTicket when RFTA has reason to believe that the circumstances prompting the change, cancellation, or replacement is the result of fraud.

If an mTicket was purchased using funds from a Stored Value Account, any refund returns the value to the Stored Value Account. RFTA will not provide a cash reimbursement under any circumstances. Please note that refunds shall be for only the mTicket(s) price. Any other associated fees are non-refundable.

Stored Value Accounts with no activity (funds added or purchase made) for five years are considered Dormant. RFTA will transfer the remaining Stored Value Account balance to the State of Colorado according to the Colorado Unclaimed Property Act.

MATERIALS, OWNERSHIP, AND RESTRICTIONS ON USE

RFTA offers the RFTA Tickets App. RFTA or its third-party licensors either own it (including without limitation, Masabi), and any data, text, graphics, images, audio and video clips, logos, icons, software and links, and any intellectual property and other rights relating thereto are and will remain the property of RFTA or Masabi or their respective licensors. You may not copy, reproduce, republish, upload, post, transmit or distribute the RFTA Tickets App or any of its content without the prior written permission of RFTA and its licensors. Nor may you: (i) reverse engineer, decompile or seek to obtain the source code to the RFTA Tickets App, except where and to the extent expressly required to be permitted by applicable law; or (ii) make or seek to make derivative works based on the RFTA Tickets App. By using or downloading the RFTA Tickets App, you agree to these terms and conditions. The RFTA Mobile Tickets App is supplied to you by RFTA, and neither Masabi nor any of RFTA’s other third-party licensors shall have any liability to you arising out of or in connection with the RFTA Tickets App.

Colorado law applies to these terms and conditions, and users agree that any dispute between RFTA and the users of the RFTA Tickets App regarding the RFTA Tickets App, sales of RFTA mTickets, or arising out of or in connection with these terms and conditions will be exclusively in   District Courts of either Pitkin County or Garfield County, State of Colorado.

DISCLAIMER OF WARRANTIES

RFTA and Masabi expressly disclaim any representation or warranty, express or implied, including, without limitation, any implied or express warranty of merchantability or fitness for a particular purpose, and any warranties regarding the security, reliability, timeliness and performance of the RFTA Tickets App.

LIABILITY DISCLAIMER

In no event will RFTA, its employees, directors, and agents be liable to you or to any third-party for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind directly or indirectly arising out of or related to your use or access to the RFTA Tickets App, including loss of data, loss of profit or the like, whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise. In no event will Masabi be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of or in connection with your use or access to any mTicket or the RFTA Tickets App, including loss of profit or the like, whether or not in the contemplation of the parties, whether based on breach of contract, tort (including negligence), product liability or otherwise. Neither RFTA nor Masabi shall be liable for any damage or alteration to your equipment, including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the RFTA Tickets App or any mTicket. Nothing in these terms and conditions shall exclude or limit a person’s liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation or any other liability which cannot be excluded or limited under applicable law.

RFTA is a statutory political subdivision of the State of Colorado and is subject to the Colorado Governmental Immunity Act, C.R.S. § 24-10-101, et seq. Nothing in these terms and conditions shall be construed as an express or implied waiver by RFTA of its governmental immunity, including limitations of amounts, types of liability, or governmental acceptance by RFTA of liabilities arising as a result of actions which lie in tort or could lie in tort in excess of the liabilities allowable under the Colorado Governmental Immunity Act.

INDEMNIFICATION

You agree to indemnify and hold RFTA, its employees, directors, and agents and Masabi harmless from and against any all claims, damages, losses, costs, expenses, or liabilities relating to, arising from, or as a result of your use or access to the RFTA Tickets App. You agree to pay any costs, including reasonable attorneys’ fees, incurred by RFTA to enforce these terms and conditions.

PRIVACY

The collection, use, and security of information obtained from customers using “RFTA Tickets” are subject to RFTA’s Mobile Ticketing Privacy Policy, as may be amended from time to time, as deemed necessary by RFTA.
