TERMS AND CONDITIONS OF THE RFTA 2019 – 2020 OPERATIONS WINTER SEASON BONUS PLAN

RFTA Operations offers to you the 2019 – 2020 WINTER SEASON BONUS PLAN (“the Plan”) spelled out in the following pages.  You are invited to read through this Plan, to see the additional earnings that may be available to you during this Winter Season, and then to work towards the receipt of as many bonus dollars as you believe you can earn by the end of the Winter Season in mid-April 2020.

Background Information on the Plan:  All sections and sub-sections of the Plan, as set forth within this document, have been developed by RFTA Management as a compensation incentive for RFTA Operations employees for the 2019 – 2020 Winter Season ONLY.  The time period for which this Plan is effective will not exceed the following dates:  November 28, 2019 (Thanksgiving Day) through April 19, 2020.  No other written and/or verbal statements or Agreements to the contrary will in any way be applicable to this Plan, nor will they be honored by RFTA Management.  Further, the terms and conditions of the Plan are not to be misunderstood or misconstrued as applicable to any time period other than the specific dates set forth above.

While RFTA Management intends to adhere to and to implement this Plan, it should be understood by all parties that RFTA Management reserves the sole right to modify and/or to rescind any or all portions of the Plan at any time and for any reason.  Finally, any interested parties should understand that by implementing the terms and conditions of the Plan, RFTA Management in no way commits, implicitly or explicitly, to implement all or any portion of this Plan at any future time or during any subsequent season or period.  Again, the Plan is effective ONLY for the 2019 – 2020 Winter Season.

End of Season Bonus:  Seasonal Employees are entitled to an End of Season Bonus based on the cumulative number of winters they have worked at RFTA consecutively or nonconsecutively, whichever Bonus amount is greater.  See bonus eligibility guidelines regarding dates and hours worked for additional guidelines.

¹Bonus Cap = Up to $3,000.  Eligibility for Bonuses is up to $3,000.
² Paid as soon as reasonably possible after the Bus Operator’s completion of his/her final scheduled shift of the 2019 – 2020 Winter Season, but no later than 30 calendar days following the last day of the season, which ends April 19, 2020).  Bonuses are up to this amount if all requirements are met.
* No credit for previous service, as it pertains to bonus eligibility, will be granted for employees who return after five years have elapsed since their last winter season employment with RFTA.  Credit for previous service is only applicable during the past five winter seasons; no credit will be granted for winter seasons worked, except for winter seasons during the previous five seasons.  Summer seasons are not applicable.
** Consecutive is defined as working full time for two or more successive winter seasons at RFTA; returning operators must have worked the prior winter season in a full time, seasonal, capacity, as defined herein, commit to working this current season no later than November 1st, and must be available to be scheduled for full-time work no later than November 28, 2019.

BONUS #2: 

Safety Bonus

§ Full-time Operations Employees in the following positions:

ð  CDL Bus Operators

ð  Non-CDL Bus Operators

ð  Transportation Supervisors

ð  Relief Supervisors

§ Paid if eligible employee has NO preventable accidents (Workers’ Comp-related or otherwise) between his/her first scheduled shift on or after November 28, 2019 and his/her final scheduled shift of the Winter Season.

§ Paid if eligible employee has only one (1) preventable accident (Workers’ Comp-related or otherwise) with a point assessment of 0.5 between his/her first scheduled shift on or after November 28, 2019 and his/her final scheduled shift of the Winter Season. Two preventable accidents or one accident with an assessment of 1.0 or more will disqualify you from receiving a safety bonus.

§ Bonus will be prorated weekly for drivers starting their work bid after January 1, 2020.

BONUS #3:

Weekend Differential Bonus

§ Full-time Operations Employees in the following positions:

 

ð  CDL Bus Operators

ð  Non-CDL Bus Operators

§  $500*

 

§  $250*

§ Paid if eligible employee selects or is assigned a winter bid with both Saturday and Sunday, between his/her first scheduled shift on or after November 28, 2019 and his/her final scheduled shift of the Winter Season.¹

§ Paid if eligible employee selects or is assigned a winter bid with one weekend shift, i.e. Saturday or Sunday, between his/her first scheduled shift on or after November 28, 2019 and his/her final scheduled shift of the Winter Season.²

§ The weekend bonus payout will be prorated, week to week, for drivers whose work bids start after December 8, 2019, or are assigned shifts on a weekly basis. Any driver starting after February 1, 2020 will not be eligible for a weekend bonus.

* Paid as soon as reasonably possible after the Bus Operator’s completion of his/her final scheduled shift of the 2019 – 2020 Winter Season, but no later than 30 calendar days following the last day of the season, which ends April 19, 2020).
¹ If you cannot work some of your scheduled weekend days on your bid for any reason, the bonus amount will be reduced.  If you have both a Saturday and Sunday scheduled on your work bid that runs from December 8, 2019 through April 21, 2020 and you miss one weekend shift, you still get the full bonus of $500.00. If you miss 2 weekend shifts you will receive a $250.00 bonus. If you miss 3 weekend shifts on your bid there will be no weekend bonus payout at the end of the winter season.
² If you cannot work some of your scheduled weekend days on your bid for any reason, the bonus amount will be reduced.  If you have a either a Saturday or Sunday only scheduled on your winter work bid that runs from December 8, 2019 through April 21, 2020 and you miss one weekend shift, you will still get the full bonus of $250.00. If you miss 2 weekend shifts you will receive $125.00. If you miss 3 weekend shifts on your bid there will be no weekend bonus payout at the end of the winter season.

BONUS #4:

 

Employee    Referral Bonus

§ All RFTA Employees in ANY employment classification (including Full-time Regulars, Part-time Regulars, Full-time Seasonals, Part-time Seasonals, Temporaries).

Exception:  Members of the Hiring and Recruitment Team are excluded from participation in the Employee Referral Bonus Program.

§ $250

§ Paid to current RFTA employee for referral of a new CDL Bus Operator candidate, where an applicant is successfully hired and completes one season of continuous employment at RFTA.▲

▲Important:

1.     A Referral Bonus is applicable to newly hired CDL Bus Operators ONLY, excludes returning seasonal CDL Bus Operators.

2.     An applicant for an open position must complete a RFTA application.

3.     The applicant, otherwise known as the referred employee, must list the current, or referring, employee’s name on the application where the application asks:  “referred by name”.

4.     The applicant must be hired by RFTA and complete a full season.

▲ Very Important:  No Referral Bonus will be paid out at the conclusion of the referred employee’s first Season of continuous RFTA employment if the referring employee’s name is not listed on the referred employee’s original application.  No exceptions to this requirement.

 


Winter Season Employee Benefit:

³Once the Winter Ski Voucher is picked up (and the agreement is signed and recorded in Human Resources), the decision may not be rescinded in exchange for receipt of the Wellness Cash Payout.

Not Eligible for BenefitPart-time and Temporary employees (neither full-time, nor part-time temps).

§  Year Round regulars and full-time seasonals may choose EITHER (but not both) the Winter Ski Pass OR the Wellness Cash Payoutª

 

 

§  ªSki Voucher Option:  If option chosen, voucher may be picked-up in Human Resources after employee orientation training (not prior to employee’s 1st day of work or orientation training).

§  ªWellness Cash Payout Option:  If option chosen, an amount equal to the RFTA-negotiated price of a 2019 – 2020 Winter Season Ski Voucher will be paid to employee as part of employee’s End of Season Bonus.  For Year Round Regular Employees, Bonus is paid in late December or Early January.ª

ªBoth benefits are considered taxable income.  Tax based on the declared value of the voucher (which will be same as the payout amount).

ð  Newly Hired CDL Bus Operators with a current CDL Class B Driver’s License with a Passenger and Air Break Endorsement

Not Eligible for BenefitPart-time and Temporary employees (neither full-time, nor part-time temps).

§  Up to $500.00¹

 

§  Paid to New Operations employee that, prior to working for RFTA, holds a valid CDL License with both Passenger and Airbrake Endorsements.

§  Prior RFTA employees are not eligible for this benefit, regardless of whether they obtained their CDL through RFTA training or testing.

§  Bonus is paid out at the Completion of first full season worked. ¹

 ¹Paid as soon as reasonably possible after the Bus Operator’s completion of his/her final scheduled shift of the 2019 – 2020 Winter Season, but no later than 30 calendar days following the last day of the season, which ends April 19, 2020).

The following guidelines govern the implementation of the 2019 – 2020 WINTER SEASON BONUS PLAN.  PLEASE READ!

RFTA Bonus Payout Guidelines

  1. 2019 – 2020 Operations Winter Season Bonus Program Eligibility Period:

Unless specifically stated otherwise in the bonus plan descriptions on the previous pages or in one of the Bonus Payout Guidelines below, this 2019 – 2020 Operations Winter Season Bonus Plan is applicable to and effective for the following period ONLY:  November 28, 2019 through April 19, 2020.

  1. Payout Guidelines and Requirements Applicable to ALL 2019 – 2020 Winter Season Bonus Plans (Refer to BONUS PLANS #1, #2, and #4…..on pages 1, 2, and 3)

To qualify for a payout related to one or more 2019 – 2020 Operations Winter Season Bonus (again, refer to pages 1 – 5 of this plan for eligibility requirements for each bonus program) new and returning Winter Seasonal employees must:

  1. …be available for scheduled full-time work (meaning 37 hours or more per work week) with no restrictions, no limitations, and/or no other known exceptions throughout the entire period of his or her Winter Seasonal employment (between his/her first and final scheduled shifts of the season).
  2. End of Season Bonuses are available for full bid winter seasonal drivers who work a minimum of 90% of their bid. Bonuses vary based on how many winter seasons each seasonal employee has worked.
  3. To receive an End of Season Bonus, a full time employee must have begun their 2019 – 2020 Winter Season employment by November 28, 2019. See Exception below.
  4. To receive an End of Season Bonus, a full time employee must be available through the completion of the Winter Season, or April 19, 2020 to receive these bonuses.

EXCEPTION:  Winter Seasonal Bus Operators (CDL and Non-CDL), who begin their 2019 – 2020 Winter Season employment ON or AFTER November 28, 2019, still will be eligible to participate in the 2019 – 2020 Operations Winter Season Bonus Plan; however, any bonus(es) earned will be paid out on a prorated basis (prorated from employee’s first day of seasonal employment through his or her final day of seasonal employment for the 2019 – 2020 Winter Season).

  1. Payout Guidelines & Requirements Applicable to…
  2. “ACTIVE” EMPLOYEES ONLY – To receive a bonus payout of any kind or type, an employee must be an “active” RFTA employee…meaning that he or she must be employed currently AND currently working (…not on a LEAVE of any kind) in any capacity and/or classification at the time of the payout.

      EXCEPTIONS

  • Seasonal Employees may be eligible for a bonus PAYOUT after they leave rfta Due to the nature and timing of “seasonal employment”, a seasonal employee (winter and/or summer season) may receive a bonus payout following the completion of the season IF he or she met all requirements applicable to the bonus plan or plans prior to the end of his or her seasonal employment.
  • Terminated Employees not eligible for a bonus payout An employee working in ANY other capacity will NOT be eligible to receive an earned bonus payout IF his or her employment is terminated, voluntarily or involuntarily, prior to the scheduled payout of the applicable bonus or bonuses.
  1. MANAGEMENT-APPROVED LEAVE OF ABSENCE – If an employee (other than a “seasonal employee”) has met all the criteria required for the receipt of one or more bonus payouts, BUT is “out” on a management-approved leave of absence (wwother than a PERSONAL LEAVE OF ABSENCE longer than 30 calendar days) at the time of the scheduled payout of the applicable bonus or bonuses, then the employee on leave (wwexcluding an employee on a PERSONAL LEAVE OF ABSENCE) IS eligible to receive the payout or payouts in question.

 A RFTA employee out on a PERSONAL LEAVE OF ABSENCE longer than 30 calendar days at the time of the scheduled payout of the applicable bonus or bonuses IS NOT eligible to receive a bonus payout of any kind or type.

  1. OUTSTANDING FINANCIAL OBLIGATIONS TO RFTA – If at the time of the payout of an earned bonus an employee, who otherwise would be eligible to receive the bonus payout(s), has an outstanding financial obligation / debt owed to RFTA, then the actual amount of that financial obligation or a reasonably assessed value of that debt (as assessed by the CEO and the Finance Director with input from one or both Operations Directors) will be deducted from the gross amount of any bonus payout(s) otherwise due the employee BEFORE the employee in question receives a payout for the bonus he or she may have earned previously.

If the balance owed to RFTA by the employee is equal to or greater than the amount of the bonus or bonuses earned, the employee will not receive a payout.
